1 Geltungsbereich
Für sämtliche Verträge zwischen dem Kunden und der Firma Eventura, Am Pannofen 59, 47608 Geldern, (nachfolgend Eventura genannt) vertreten durch ihren Geschäftsführer Stephan Hermsen, gelten ausschließlich diese "Allgemeinen Geschäftsbedingungen". Entgegenstehende Geschäftsbedingungen des Kunden sind nur dann wirksam, wenn sie von Eventura ausdrücklich und schriftlich anerkannt werden. Von diesen "Allgemeinen Geschäftsbedingungen" abweichende oder diese ergänzenden Vereinbarungen bedürfen der Schriftform. Sollten einzelne Bestimmungen dieser "Allgemeinen Geschäftsbedingungen" unwirksam sein, so berührt dies die Verbindlichkeit der übrigen Bestimmungen und der unter ihrer Zugrundelegung geschlossenen Verträge nicht. Die unwirksame Bestimmung ist durch eine wirksame, die ihr dem Sinn und Zweck nach am nächsten kommt, zu ersetzen.
1 Scope of application
For all contracts between the client and the company Eventura, Am Pannofen 59, 47608 Geldern, (hereinafter referred to as Eventura) represented by its managing director Stephan Hermsen, these “General Terms and Conditions” apply exclusively. Conflicting terms and conditions of the client are only effective if they are expressly recognized by Eventura in writing. Agreements deviating from or supplementing these “General Terms and Conditions” must be made in writing. Should individual provisions of these “General Terms and Conditions” be invalid, this shall not affect the binding nature of the remaining provisions and the contracts concluded on the basis thereof. The invalid provision shall be replaced by a valid provision that comes as close as possible to the meaning and purpose of the invalid provision.
2Allgemeines
2.1 ANGEBOTE
Alle Angebote von Eventura sind freibleibend bis zum Festabschluss; ein gültiger Mietvertrag kommt mit der schriftlichen Auftragsbestätigung durch Eventura zustande. Der Abschluss eines Mietvertrages sowie Änderungen des Mietvertrages bedürfen der Schriftform. Mündliche Nebenabreden sind unwirksam. Inhalt und Umfang des Mietvertrages wird durch die schriftliche Auftragsbestätigung bestimmt. Angebotsunterlagen, etwaige Fehler in Verkaufsprospekten, Preislisten, Angebotsunterlagen, Homepage oder sonstigen Dokumentationen von Eventura sind rechtlich unbeachtlich, entsprechende Haftung gegenüber Kunden resultiert hieraus nicht. Insbesondere sind diese Unterlagen nicht als Angebot im Rechtssinne zu verstehen, sondern gerade unverbindlich und freibleibend.
2 General
2.1 OFFERS
All offers from Eventura are subject to change until a firm contract is concluded; a valid rental contract is concluded with the written order confirmation from Eventura. The conclusion of a rental contract and amendments to the rental contract must be made in writing. Verbal collateral agreements are invalid. The content and scope of the rental contract is determined by the written order confirmation. Offer documents, any errors in sales brochures, price lists, offer documents, homepage or other documentation of Eventura are legally irrelevant, corresponding liability towards customers does not result from this. In particular, these documents are not to be understood as an offer in the legal sense, but are non-binding and subject to change.
2.2 ZAHLUNGSBEDINGUNGEN
Der Entgeltanspruch von Eventura für jede einzelne Leistung entsteht, sobald diese wie vereinbart erbracht wurde, mit Ausnahme der Zahlungsbedingung Vorkasse. Hier entsteht der Entgeltanspruch vor Leistungserbringung. Eventura behält sich vor, zusätzlich eine Kaution zu erheben, die bei ordnungsgemäßer Rückgabe des Mietgegenstandes zurückgezahlt wird. Rechnungen sind gemäß dem vereinbarten Zahlungsziel nach Erhalt der Rechnung fristgerecht zu zahlen. Sofern nicht ausdrücklich verlangt, erfolgt der Rechnungsversand ausschließlich digital. Bei Verzug ist Eventura berechtigt, Verzugszinsen zu erheben. Der Verzugszinssatz beträgt für das Jahr 5 % über dem Basiszinssatz. Durch Verzug entstehende Kosten wie Mahngebühren, Rechtskosten, Inkassokosten usw. hat der Kunde in voller Höhe zusätzlich zu tragen.
2.2 TERMS OF PAYMENT
Eventura's claim to payment for each individual service arises as soon as it has been provided as agreed, with the exception of the payment condition of advance payment. In this case, the claim for payment arises before the service is provided. Eventura reserves the right to charge an additional deposit, which will be refunded upon proper return of the rental object. Invoices are to be paid on time in accordance with the agreed payment term after receipt of the invoice. Unless expressly requested, invoices will only be sent digitally. In the event of default, Eventura is entitled to charge interest on arrears. The default interest rate for the year is 5% above the prime rate. Costs incurred by default, such as reminder fees, legal costs, collection costs, etc., must be borne in full by the customer.
2.3 VORSCHÜSSE
Eventura ist berechtigt, zur Deckung von Aufwendungen Vorschüsse zu verlangen. Eventura ist verpflichtet, nach den Grundsätzen eines sorgfältigen Kaufmanns unter Beachtung der Interessen des Auftraggebers dieses Geld für die Durchführung des Kundenauftrages einzusetzen. Die für die Durchführung des Events notwendigen Beträge werden durch den Auftraggeber Eventura innerhalb eines vereinbarten Zeitraumes zur Verfügung gestellt.
2.3 ADVANCES
Eventura is entitled to demand advance payments to cover expenses. Eventura is obliged to use this money for the execution of the client's order in accordance with the principles of a prudent businessman, taking into account the interests of the client. The amounts required to carry out the event will be made available to Eventura by the client within an agreed period of time.
2.4 KOSTEN BEI RÜCKTRITT
Tritt der Kunde von einem bereits bestehenden Vertrag zurück, so ist Eventura berechtigt - wenn nicht anders schriftlich vereinbart - nachweislich entstandene Kosten in voller Höhe in Rechnung zu stellen. Bei Rücktritt von Miet- und Serviceverträgen zahlt er jedoch mindestens die nachfolgend angegebenen Sätze.
a) 20% des Nettomietpreises zzgl. der jeweils gültigen gesetzlichen Mehrwertsteuer bis 20 Arbeitstage vor Mietbeginn
b) 50% des Nettomietpreises zzgl. der jeweils gültigen gesetzlichen Mehrwertsteuer bis 7 Arbeitstage vor Mietbeginn
c) 70% des Nettomietpreises zzgl. der jeweils gültigen gesetzlichen Mehrwertsteuer bis 3 Arbeitstage vor Mietbeginn
d) 90% des Nettomietpreises zzgl. der jeweils gültigen gesetzlichen Mehrwertsteuer bei Stornierungen später als 3 Arbeitstage vor Mietbeginn
Teilstornierungen werden pro rata berechnet.
Stornierungen von Fremdmaterial werden mit einer Handlinggebühr von zusätzlich 15% berechnet. Sollte das Fremdmaterial für Eventura nicht kostenfrei storniert werden können, kommen die tatsächlich entstandenen Kosten zzgl. der 15% Handlinggebühr - mindestens jedoch die o.g. Stornierungsgebühren - zur Anrechnung
2.4 COSTS OF WITHDRAWAL
If the client withdraws from an existing contract, Eventura is entitled - unless otherwise agreed in writing - to charge the full amount of the costs demonstrably incurred. However, in the event of withdrawal from rental and service contracts, the client shall pay at least the following rates.
a) 20% of the net rental price plus the applicable statutory VAT up to 20 working days before the start of the rental period
b) 50% of the net rental price plus the applicable statutory VAT up to 7 working days before the start of the rental period
c) 70% of the net rental price plus the applicable statutory VAT up to 3 working days before the start of the rental period
d) 90% of the net rental price plus the applicable statutory value-added tax if canceled later than 3 working days before the start of the rental period
Partial cancellations will be charged pro rata.
Cancellations of third-party material will be charged with an additional handling fee of 15%. If the third-party material cannot be canceled free of charge for Eventura, the actual costs incurred plus the 15% handling fee - but at least the above-mentioned cancellation fees - will be charged
2.5 HONORARKÜRZUNGEN
Honorarkürzungen aufgrund ersparter Aufwendungen werden von Eventura ausgeschlossen.
2.5 FEE REDUCTIONS
Eventura excludes fee reductions due to saved expenses.
2.6 GEMA / BEHÖRDEN / VERSICHERUNG / GENEHMIGUNGEN
Der Kunde ist für sämtliche anfallenden Gebühren, Versicherungen, Genehmigungen und Steuern zuständig (z.B. GEMA, Vergnügungssteuer, Veranstalter-Haftpflichtversicherung usw.).
2.6 GEMA / AUTHORITIES / INSURANCE / PERMITS
The customer is responsible for all fees, insurance, permits and taxes (e.g. GEMA, entertainment tax, organizer's liability insurance, etc.).
2.7 VERTRÄGE MIT DRITTEN
Soweit Eventura Verträge zur Durchführung einer Veranstaltung mit Dritten schließt, erfolgt ein solcher Vertragsabschluss im Namen und mit Vollmacht des Kunden. Dies betrifft insbesondere die Anmietung von Räumen, den Abschluss von Verträgen im Gastronomiebereich sowie den Abschluss von Verträgen mit Künstlern & Co.
2.7 CONTRACTS WITH THIRD PARTIES
Insofar as Eventura concludes contracts with third parties for the organization of an event, such contracts are concluded in the name and with the authorization of the client. This applies in particular to the rental of rooms, the conclusion of contracts in the catering sector and the conclusion of contracts with artists & co.
2.8 EIGENTUMSVORBEHALT
Soweit wir Ware verkaufen, bleibt diese Ware Eigentum von Eventura bis alle Verbindlichkeiten des Kunden gegenüber Eventura getilgt sind.
2.8 RETENTION OF TITLE
If we sell goods, these goods remain the property of Eventura until all liabilities of the customer to Eventura have been settled.
2.9 EIGENTUMSRECHT UND URHEBERSCHUTZ
Alle Leistungen von Eventura (z.B. Ideen, Konzepte für Veranstaltungen etc.) - auch einzelne Teile daraus - bleiben Eigentum von Eventura. Der Kunde erwirbt durch Zahlung des Honorars nur das Recht zur einmaligen Nutzung oder zum vereinbarten Zweck. Ohne gegenteilige Vereinbarung mit Eventura darf der Kunde die Leistungen von Eventura nur selbst, ausschließlich in Deutschland und nur für die Dauer des Vertrages nutzen.
2.9 PROPERTY RIGHTS AND COPYRIGHT PROTECTION
All services provided by Eventura (e.g. ideas, concepts for events, etc.) - including individual parts thereof - remain the property of Eventura. By paying the fee, the client only acquires the right to one-time use or for the agreed purpose. Unless otherwise agreed with Eventura, the client may only use Eventura's services himself, exclusively in Germany and only for the duration of the contract.
2.10 LEISTUNGSABWEICHUNGEN VOM VERTRAG
Änderungen oder Abweichungen einzelner Leistungen von dem vereinbarten Inhalt des Vertrages, die nach Vertragsabschluss notwendig werden, teilt Eventura dem Kunden unverzüglich mit. Soweit durch die Veränderungen der vereinbarte Inhalt des Vertrages nicht oder nur unwesentlich berührt wird, steht – aufgrund dieser Abweichungen – dem Kunden kein Kündigungsrecht zu. Eventura ist berechtigt, in Abstimmung mit dem Kunden Teile des Veranstaltungsablaufes in Abweichung von der Leistungsbeschreibung zu verändern.
2.10 DEVIATIONS FROM THE CONTRACT
Eventura will inform the client immediately of any changes or deviations of individual services from the agreed content of the contract that become necessary after conclusion of the contract. Insofar as the agreed content of the contract is not or only insignificantly affected by the changes, the client is not entitled to terminate the contract due to these deviations. Eventura is entitled, in consultation with the client, to change parts of the event schedule in deviation from the service description.
2.11 TRANSPORT UND AUFBAU
Die Anlieferung zum und die Abholung von dem durch den Kunde angegebenen Ort erfolgt nur nach schriftlicher Vereinbarung und gegen gesonderte Berechnung, es sei denn, es ist vertraglich etwas anderes vereinbart. Die Transportkosten können bei Eventura erfragt werden.
Die Transportleistung von Eventura beinhaltet grundsätzlich die Anlieferung bis hinter die erste ebenerdige Tür, eine direkte und störungsfreie Anfahrtsmöglichkeit an den Ab- und Beladeort vorausgesetzt. Ab einem Transportweg, der 10 m zwischen Transportfahrzeug und Abladeort überschreitet, werden zu den Transportkosten zusätzliche Arbeitsstunden in Höhe von mindestens 39,99 € (Abrechnung erfolgt nach den aktuell geltenden Stundensätzen) pro Stunde pro Mitarbeiter nach Aufwand berechnet. Transportwege müssen so beschaffen sein, dass rollbare Ware durch eine Person barriere-, beschädigungs- und störungsfrei bewegt werden kann. Sollte dies nicht gegeben sein, wird der zusätzliche Aufwand mit 39,99 € pro Stunde pro Mitarbeiter nach Aufwand gesondert berechnet. Die Zufahrt muss für einen LKW (Breite 3,00 m Höhe 4,00 m Länge 20,00 m Gewicht 40 t) gewährleistet sein. Sollte dies nicht der Fall sein, muss der Kunde Eventura hierüber vorab schriftlich informieren, mindestens 48 Stunden vor Lieferung. Sollten Eventura diese Informationen nicht zugehen und eine weitere Anfahrt notwendig werden, so trägt der Kunde die Kosten für den zusätzlichen Aufwand. Wartezeiten, die nicht durch Eventura zu vertreten sind,
werden mit jeweils 39,99 € pro Stunde pro Mitarbeiter dem Kunden in Rechnung gestellt. Sollte Ware aufgrund der Transportwege nicht wie vereinbart ausgeliefert werden können, muss der Kunde die vereinbarte Miete in voller Höhe tragen.
2.11 TRANSPORTATION AND ASSEMBLY
Delivery to and collection from the location specified by the client shall only take place by written agreement and for a separate charge, unless otherwise contractually agreed. The transportation costs can be requested from Eventura.
Eventura's transportation service generally includes delivery to behind the first ground-level door, provided there is a direct and trouble-free access to the unloading and loading location. If the transportation distance between the transport vehicle and the unloading location exceeds 10 m, additional working hours of at least €39.99 per hour per employee will be charged in addition to the transportation costs (invoicing will be based on the currently applicable hourly rates). Transport routes must be such that goods on wheels can be moved by one person without any barriers, damage or disruption. If this is not the case, the additional effort will be charged separately at € 39.99 per hour per employee on a time and material basis. Access must be guaranteed for a truck (width 3.00 m height 4.00 m length 20.00 m weight 40 t). If this is not the case, the client must inform Eventura of this in writing in advance, at least 48 hours before delivery. If Eventura does not receive this information and an additional journey is necessary, the client shall bear the costs for the additional effort. Waiting times for which Eventura is not responsible,
will be charged to the customer at €39.99 per hour per employee. If goods cannot be delivered as agreed due to transportation routes, the client must pay the agreed rent in full.
2.12 HANDLING
Auf- und Abbau sowie Verteilen und Einsammeln der Mietgegenstände sind in unserem Angebot nicht enthalten, solange nicht anders vereinbart. Diese Leistungen übernehmen wir gerne gegen gesonderte Berechnung.

Assembly and dismantling as well as distribution and collection of the rental items are not included in our offer, unless otherwise agreed. We are happy to provide these services for a separate charge.
2.13ABBILDUNGEN / FOTOS
Abbildungen in Katalogen, Broschüren, Mailings sowie in Internetseiten und Multimediapräsentationen auf CD/DVD können von der Wirklichkeit abweichen. Dies gilt besonders für Farbunterschiede, die nicht immer völlig ausgeschlossen werden können.
2.13 ILLUSTRATIONS / PHOTOS
Illustrations in catalogs, brochures, mailings, Internet pages and multimedia presentations on CD/DVD may differ from reality. This applies in particular to color differences, which cannot always be completely ruled out.
2.14 COPYRIGHT / URHEBERRECHT
Sämtliche Inhalte und Gestaltungsformen sind urheberrechtlich geschützt. Jegliche unberechtigte Nutzung, insbesondere durch Nachdruck oder Vervielfältigung, werden gerichtlich verfolgt. Die Übernahme des Inhalts oder von Auszügen daraus für gewerbliche, private oder andere Zwecke sind verboten. Für Satz- und Formfehler redaktioneller oder technischer Art wird keine Haftung übernommen und kein Schadenersatz geleistet.
2.14 COPYRIGHT
All content and designs are protected by copyright. Any unauthorized use, in particular by reprinting or copying, will be prosecuted. The use of the content or excerpts thereof for commercial, private or other purposes is prohibited. No liability is accepted and no compensation paid for typesetting and formal errors of an editorial or technical nature.
2.15 VERPFLEGUNG MITARBEITER
Mitarbeiter von Eventura müssen ab 6 Arbeitsstunden beim Auf- und Abbau mit einer sättigenden, ausgewogenen Mahlzeit sowie mit nichtalkoholischen Getränken und Kaffee versorgt werden. Bei 12 Arbeitsstunden sind derweil 2 Mahlzeiten zu stellen. Mitarbeiter, die eine Veranstaltung betreuen, nehmen grundsätzlich am Veranstaltungscatering teil, es sei denn, es wird ein gesondertes Crewcatering gestellt. Zugang zu WC-Anlagen ist bei Auf- und Abbauarbeiten jederzeit kundenseits sicherzustellen.
2.15 EMPLOYEE CATERING
Eventura employees must be provided with a filling, balanced meal as well as non-alcoholic drinks and coffee from 6 working hours during set-up and dismantling. For 12 working hours, 2 meals must be provided. Employees who supervise an event are generally included in the event catering, unless separate crew catering is provided. Access to WC facilities must be ensured by the customer at all times during set-up and dismantling work.
2.16 GERICHTSSTAND
Gerichtsstand und Erfüllungsort ist das Gericht, in dessen Bezirk Eventura seinen Sitz hat.
2.16 JURISDICTION
The place of jurisdiction and place of performance is the court in whose district Eventura has its registered office.
3 Mietmaterial
3 Rental material
3.1 QUALITÄT DES MIETGUTES
Eventura ist verpflichtet, bestelltes Mietgut mittlerer Art und Güte zu liefern. Eventura ist berechtigt, bestelltes Mietgut durch gleichwertiges oder besseres Mietgut zu ersetzen, falls Eventura - aus welchen Gründen auch immer - nicht in der Lage ist, das bestellte Mietgut zu liefern.
3.1 QUALITY OF THE RENTED PROPERTY
Eventura is obliged to deliver ordered rental goods of average type and quality. Eventura is entitled to replace ordered rental goods with equivalent or better rental goods if Eventura - for whatever reason - is unable to deliver the ordered rental goods.
3.2 INFORMATIONSMATERIAL
Sämtliche Angaben über Mietgegenstände, die in Prospekten, Verzeichnissen oder Unterlagen jeglicher Art enthalten sind, soweit sie technische Leistung, Betriebseigenschaften oder Verwendbarkeit betreffen, sind unverbindlich, soweit die einzelnen Angaben nicht schriftlich durch Eventura bestätigt worden sind. Eventura steht nicht für die Richtigkeit von Herstellerangaben ein.
3.2 INFORMATION MATERIAL
All information about rental objects contained in brochures, directories or documents of any kind, insofar as they relate to technical performance, operating characteristics or usability, are non-binding unless the individual details have been confirmed in writing by Eventura. Eventura is not responsible for the accuracy of the manufacturer's information.
3.3 WEITERGABE AN DRITTE / BEFÖRDERUNG
Eine Vermietung und Weitergabe des Mietgegenstandes an Dritte und/oder das Befördern und Betreiben des Mietgegenstandes außerhalb der BRD ist ohne schriftliche Genehmigung der Firma Eventura untersagt. Für sämtliche Folgeschäden, die aus der Nichtbeachtung dieser Auflage resultieren, haftet der Kunde in vollem Umfang
3.3 TRANSFER TO THIRD PARTIES / TRANSPORTATION
Renting and transferring the rental object to third parties and/or transporting and operating the rental object outside of Germany is prohibited without the written permission of Eventura. The customer is fully liable for all consequential damages resulting from non-compliance with this requirement
3.4 MIETZEITRAUM / ÜBERZIEHUNG
Die Miete beginnt an dem Tage, an welchem dem Kunde der Mietgegenstand ausgehändigt worden ist, und endet zu dem Zeitpunkt, der als Rückgabetermin angegeben wurde. Wir behalten uns vor, bei Überziehung dieses Termins Ausfallkosten in Höhe des täglichen Mietpreises zu berechnen und ggf. einen darüberhinausgehenden Schaden zu liquidieren. Auf § 546a BGB wird Bezug genommen. Sind wir gezwungen, die Rückgabe von Mietgegenständen anzumahnen, haben wir das Recht, ab der ersten Mahnung einen Mahnbetrag von jeweils 10 € pro Mahnung zu erheben. Die Preise der jeweils gültigen Preisliste verstehen sich zzgl. der jeweils gültigen gesetzlichen Mehrwertsteuer und gelten jeweils für die Miete von bis zu drei Kalendertagen oder einem Wochenende, wenn nichts anderes schriftlich vereinbart ist.
3.4 RENTAL PERIOD / OVERDRAFT
The rental period begins on the day on which the rental item is handed over to the customer and ends on the date specified as the return date. If this date is exceeded, we reserve the right to charge cancellation costs in the amount of the daily rental price and, if necessary, to liquidate any additional damages. Reference is made to § 546a BGB. If we are forced to send reminders for the return of rental items, we have the right to charge a reminder fee of €10 per reminder from the first reminder. Unless otherwise agreed in writing, the prices in the current price list do not include the applicable statutory VAT and are valid for rental periods of up to three calendar days or a weekend.
3.5 VERWENDUNGSZWECK & FUNKTIONSPRÜFUNG
Der Kunde ist verpflichtet, den Vermieter über den beabsichtigten Verwendungszweck genauestens zu informieren. Der Kunde ist verpflichtet, sich bei Übernahme oder vor Inbetriebnahme der Mietsache und des Zubehörs von deren einwandfreiem Zustand, richtiger Funktion und Vollständigkeit zu überzeugen. Der Kunde ist in jedem Fall verpflichtet, vor der beabsichtigten Inbetriebnahme die Geräte vollständig zu erproben. Die Übernahme der Mietsache gilt als Bestätigung des einwandfreien und zum vertragsgemäßen Gebrauch geeigneten Zustandes. Wenn und soweit der Mietgegenstand einer speziellen Behandlung bedarf (z.B. gem. Betriebsanleitung o.ä.) verpflichtet sich der Kunde, den Mietgegenstand ausschließlich durch Personen bedienen zu lassen, die einen ordnungsgemäßen Gebrauch der Mietsache sicherstellen können.
3.5 INTENDED USE & FUNCTION TEST
The customer is obliged to inform the lessor in detail about the intended purpose of use. In any case, the customer is obliged to fully test the equipment before the intended commissioning. If and insofar as the rented item requires special handling (e.g. in accordance with the operating instructions or similar), the customer undertakes to have the rented item operated exclusively by persons who can ensure proper use of the rented item
3.6 HAFTUNG FÜR MIETOBJEKTE UND VERSICHERUNGSSCHUTZ
Der Kunde haftet ab Erhalt des Mietgutes bis zur Rückgabe für jede Beschädigung oder den Verlust des Mietgegenstandes unabhängig davon, ob die Beschädigung oder der Verlust durch den Kunden selbst oder einen Dritten verursacht worden ist. Der Kunde tritt etwaige Schadenersatzansprüche gegen Dritte auf Verlangen an Eventura ab. Alle Mietgegenstände sind grundsätzlich nicht versichert. Der Kunde haftet für Mietgegenstände in vollem Umfang mit dem Wiederbeschaffungswert für sämtliche Schäden und Verluste sowie hierdurch evtl. entgangene Mieteinnahmen, auch wenn die Schäden nicht von ihm selbst, sondern z.B. von seinen Gästen, Personal, unbekannten Dritten oder durch höhere Gewalt verursacht wurden. Für Transportschäden und entstandene Schäden vor Ort insbesondere durch unsachgemäße Handhabung der Mietsache durch den Kunden übernimmt der Vermieter keine Haftung. Reparatureingriffe des Kunden sind nicht zulässig. Die Haftung für eine Mietsache beginnt, sobald der Mietgegenstand am angegebenen Lieferort zum vereinbarten Zeitpunkt eingetroffen und entladen ist oder die Ware abgeholt und verladen ist - auch wenn der Kunde nicht vor Ort ist oder die Übernahme durch Erfüllungsgehilfen erfolgt. Mietgegenstände gelten als ordnungsgemäß zurückgeben, sobald diese in den Geschäftsräumen von Eventura gezählt, gereinigt und geprüft wurden und keine Beanstandungen vorliegen. Eventura ist verpflichtet, binnen 14 Tagen nach Rückgabe einer Mietsache den Kunden über etwaige Schäden und Verluste zu informieren.
3.6 LIABILITY FOR RENTAL PROPERTIES AND INSURANCE COVER
The client is liable for any damage to or loss of the rental item from receipt of the rental item until its return, regardless of whether the damage or loss was caused by the client himself or a third party. The client assigns any claims for damages against third parties to Eventura upon request. All rental items are generally not insured. The client is fully liable for the replacement value of rental items for all damage and losses as well as any loss of rental income, even if the damage was not caused by the client itself but, for example, by its guests, staff, unknown third parties or by force majeure. The Rental Firm accepts no liability for transport damage and damage incurred on site, in particular due to improper handling of the rental item by the Customer. Repairs by the customer are not permitted. Liability for a rental item shall commence as soon as the rental item has arrived at the specified delivery location at the agreed time and has been unloaded or the goods have been collected and loaded - even if the customer is not on site or the takeover is carried out by vicarious agents. Rented items are deemed to have been properly returned as soon as they have been counted, cleaned and checked on Eventura's premises and there are no complaints. Eventura is obliged to inform the client of any damage or loss within 14 days of the return of a rental item.
3.7 ANZEIGEPFLICHT BEI SCHÄDEN
Der Kunde hat eventuelle Schäden, die die weitere und sofortige Benutzung der Mietsache erschwert oder unmöglich macht, unverzüglich schriftlich zu melden. Transportschäden wie auch alle anderen evtl. Schäden, wie z.B. Kratzer an den Geräten, sind dem Vermieter bei der Rückgabe anzuzeigen.
3.7 OBLIGATION TO REPORT DAMAGE
The customer must immediately report in writing any damage that makes further and immediate use of the rental item difficult or impossible. Transport damage as well as any other possible damage, e.g. scratches on the equipment, must be reported to the rental company upon return.
3.8 AUSFÄLLE / STROMVERSORGUNG
Für evtl. Ausfälle übernehmen wir keine Haftung. Der Kunde hat für ausreichende und VDE-gerechte Stromversorgung zu sorgen. Sollte dies nicht sichergestellt sein, behalten wir uns vor, den Mietvertrag aufzulösen und die darin aufgeführten Geräte nicht auszuhändigen bzw. in Betrieb zu nehmen. Die Miete wird in solch einem Fall in vollem Umfang berechnet.
3.8 FAILURES / POWER SUPPLY
We accept no liability for any failures. The customer must ensure a sufficient and VDE-compliant power supply. If this is not ensured, we reserve the right to terminate the rental contract and not to hand over or commission the equipment listed therein. In such a case, the rental fee will be charged in full.
3.9 ZUSTAND BEI RÜCKGABE
Der Kunde verpflichtet sich, den Mietgegenstand in dem Zustand zurückzugeben, indem er ihn erhalten hat. Für defekt zurückgebrachte Geräte berechnen wir die Reparaturkosten oder den Wiederbeschaffungswert, wenn eine Reparatur unmöglich oder unverhältnismäßig ist. Bei defekten Glühkörpern behalten wir uns vor, den Zeitwert zu berechnen. Bei verschmutzten Mietgegenständen berechnen wir die Reinigung nach Aufwand, solange nichts anderes vereinbart ist.
3.9 CONDITION ON RETURN
The customer undertakes to return the rental item in the condition in which it was received. For defective equipment returned, we will charge the repair costs or the replacement value if repair is impossible or disproportionate. We reserve the right to charge the current value for defective incandescent bulbs. In the case of dirty rental items, we will charge for cleaning on a time and material basis unless otherwise agreed.
3.10 ZELTE
Die angebotenen Preise bei Zelten verstehen sich inklusive Montage und Demontage, ausgenommen hiervon sind Schnellbauzelte z.B. der Serie Tento, Mastertent, Atento usw. Beim Zelt ist ein Niveauausgleich von maximal 15 cm inbegriffen. Ein Niveauausgleich darüber hinaus wird gesondert berechnet. Der Kunde muss beim Aufbau von Zelten sicherstellen, dass der Aufbauplatz für eine Verankerung der Zelte bis zu einer Tiefe von 1 m frei von jeglichen Leitungen (Strom, Gas, Wasser, Fernwärme, Abwasser, Daten- und Telefonleitungen) ist. Ist dies nicht der Fall, muss der entsprechende Leitungsweg vor Aufbaubeginn genau gekennzeichnet werden. Der Aufbauort muss frei von versteckten Kampfmitteln sein. Für etwaige Flurschäden, die beim Auf- und Abbau, durch die Standzeit oder die Fahrzeuge entstehen, kommt Eventura nicht auf. Für Schäden an Zelten durch Sturm, Unwetter oder höhere Gewalt, Vandalismus und andere Ursachen haftet der Kunde in vollem Umfang in Höhe des Wiederbeschaffungswertes der Mietsache. Des Weiteren haftet der Kunde auch für hieraus entstehende Mietausfälle in voller Höhe.
3.10 TENTS
The prices quoted for tents include assembly and dismantling, with the exception of quick-assembly tents, e.g. the Tento, Mastertent, Atento etc. series. A maximum level adjustment of 15 cm is included with the tent. Any leveling beyond this will be charged separately. When erecting tents, the customer must ensure that the site for anchoring the tents is free of any lines (electricity, gas, water, district heating, waste water, data and telephone lines) up to a depth of 1 m. If this is not the case, the customer must provide a suitable site. If this is not the case, the relevant cable route must be precisely marked before the start of assembly. The installation site must be free of hidden explosive ordnance. Eventura is not liable for any damage to the ground caused during assembly and dismantling, during the stand time or by the vehicles. The customer is fully liable for damage to tents caused by storms, thunderstorms or force majeure, vandalism and other causes to the amount of the replacement value of the rental object. Furthermore, the client is also fully liable for any resulting rental losses.
4 Haftung & Schadenersatz
4 Liability & compensation
4.1 ERFÜLLUNGSGEHILFEN
Eventura haftet nicht für grobes Verschulden seiner Erfüllungsgehilfen und Subunternehmer.
4.1 VICARIOUS AGENTS
Eventura is not liable for gross negligence on the part of its vicarious agents and subcontractors.
4.2 ABWEICHUNG VON ZUSAGEN
Der Kunde hat keinen Anspruch auf Schadenersatz oder Minderung, wenn er von ihm getroffene Zusagen (z.B. Bereitstellung von Hilfskräften, Parkplätzen, Stromversorgung, Zufahrtswegen etc.) oder andere ihm obliegende Pflichten nicht einhält und dadurch eine Vertragserfüllung seitens Eventura erst durch Mehraufwand oder verspätet möglich bzw. gänzlich unmöglich macht.
4.2 DEVIATION FROM COMMITMENTS
The client is not entitled to compensation or a reduction in price if he does not comply with his commitments (e.g. provision of auxiliary staff, parking spaces, power supply, access roads, etc.) or other obligations incumbent on him, thereby making it possible or completely impossible for Eventura to fulfill the contract due to additional costs or delays.
4.3 ANMIETUNG MIT PERSONAL
Auch bei der Anmietung von Geräten zusammen mit unserem Personal hat der Kunde unter allen Umständen dafür Sorge zu tragen, dass alles den Umständen nach Möglichen von ihm bzw. von ihm beauftragten Personen unternommen wird, um einen Schaden oder einen Verlust der Geräte zu vermeiden. Es gelten auch hierbei die Haftungsbedingungen aus § 3.6. Unser Personal haftet ausschließlich betriebstechnisch gesehen.
4.3 HIRING WITH STAFF
Even when renting equipment together with our personnel, the customer must ensure under all circumstances that everything possible under the circumstances is undertaken by him or by persons commissioned by him to avoid damage to or loss of the equipment. The liability conditions from § 3.6 also apply here. Our personnel are only liable from an operational point of view.
4.4 REKLAMATION
Der Kunde hat allfällige Reklamationen unverzüglich nach Leistung durch Eventura schriftlich geltend zu machen und zu begründen. Im Fall berechtigter und rechtzeitiger Reklamationen steht dem Kunden das Recht auf Schadenersatz zu. Die Vertragsparteien vereinbaren, dass ein Schadenersatzanspruch gegen Eventura der Höhe nach - gleich aus welchem Rechtsgrunde - auf die vereinbarte Miete oder Honorar der mangelhaften Sache beschränkt ist. Ein Schadenersatz ist nur möglich, wenn Eventura die Möglichkeit eingeräumt wird, den Mangel zu beseitigen.
4.4 COMPLAINT
The client must assert and substantiate any complaints in writing immediately after performance by Eventura. In the event of justified and timely complaints, the client is entitled to compensation. The contracting parties agree that the amount of any claim for damages against Eventura - regardless of the legal grounds - is limited to the agreed rent or fee for the defective item. Compensation for damages is only possible if Eventura is given the opportunity to remedy the defect.
4.5 HAFTUNG NACH VERTRAGSVEREINBARUNG
Die Haftung von Eventura richtet sich ausschließlich nach den schriftlichen Vereinbarungen der Parteien. Alle hierin nicht ausdrücklich zugestandenen Ansprüche, auch Schadenersatzansprüche - gleich aus welchem Rechtsgrunde – sind ausgeschlossen, es sei denn, sie beruhen auf einer vorsätzlichen oder grob fahrlässigen Vertragsverletzung durch Eventura.
4.5 LIABILITY ACCORDING TO CONTRACTUAL AGREEMENT
Eventura's liability is governed exclusively by the written agreements between the parties. All claims not expressly conceded herein, including claims for damages - regardless of the legal grounds - are excluded, unless they are based on an intentional or grossly negligent breach of contract by Eventura.
4.6 SCHÄDEN DURCH DEN MIETGEGENSTAND
Für durch unsere Mietgegenstände entstandene Schäden können wir nicht haftbar gemacht werden, wenn diese auf unsachgemäße Handhabung zurückzuführen sind.

We cannot be held liable for damage caused by our devices if this is due to improper handling.
4.7 SCHÄDEN BEIM VERLADEN
Eventura übernimmt keine Haftung für jegliche Art von Schäden, die beim Beladen oder Entladen auf den Betriebsstandorten von Eventura entstehen. Der Kunde trägt das Risiko von Schäden, wenn er Hilfe von Mitarbeitern und Erfüllungsgehilfen von Eventura beim Be- und Entladen eines eigenen Fahrzeugs in Anspruch nimmt. Auch übernimmt er die Haftung bei unsachgemäßer Beladung des eigenen Fahrzeugs. Eventura ist berechtigt, die Herausgabe von Ware zu verweigern, wenn ein Kunde einen ordnungsgemäßen Transport mit dem eigenen Fahrzeug nicht gewährleisten kann. Hieraus entsteht kein Anspruch auf Schadenersatz oder Mietminderung der gemieteten Sache.
4.7 DAMAGE DURING LOADING
Eventura accepts no liability for any damage caused during loading or unloading at Eventura's premises. The client bears the risk of damage if he uses the help of Eventura employees and vicarious agents when loading and unloading his own vehicle. He also assumes liability for improper loading of his own vehicle. Eventura is entitled to refuse to hand over goods if a customer cannot guarantee proper transportation with their own vehicle. This does not give rise to a claim for damages or a reduction in the rent for the rented item.
4.8 SCHÄDEN AN BODENBELÄGEN
Eventura übernimmt keine Haftung für jegliche Art von Schäden an Bodenbelägen, welche nicht auf grob fahrlässiges Verhalten zurückzuführen sind. Der Kunde hat sicherzustellen, dass Untergründe, auf welchen Aufbauten stattfinden sollen, dafür geeignet sind. Ferner ist er dafür verantwortlich, dass die zugewiesenen Flächen mit Flurförderfahrzeugen mit bis zu 2t befahrbar sind. Empfindliche Flächen müssen kundenseitig ausreichend geschützt oder mindestens gekennzeichnet werden. Der Kunde ist dazu verpflichtet, Eventura schriftlich auf etwaige Besonderheiten bei Bodenbelägen vorab hinzuweisen.
4.8 DAMAGE TO FLOOR COVERINGS
Eventura assumes no liability for any kind of damage to floor coverings that is not due to gross negligence. The client must ensure that surfaces on which installations are to take place are suitable for this purpose. Furthermore, the customer is responsible for ensuring that the assigned areas are accessible to industrial trucks with a maximum weight of 2 tons. Sensitive areas must be adequately protected or at least marked by the customer. The customer is obliged to inform Eventura in writing in advance of any special features of floor coverings.
Mit Erscheinen dieser AGBs verlieren alle vorherigen Fassungen ihre Gültigkeit. Es gilt für mit Eventura abgeschlossene Verträge deutsches Recht.
